Police Boss & Junior Officer Seek Court’s Help Over Blogger Ojwang’s Death

Chief Inspector Samson Taalam, the Officer Commanding Central Police Station, and Constable James Mukhwana have moved to the Milimani High Court to block what they call an illegal probe and possible prosecution over the controversial death of teacher and blogger Albert Ojwang’ while in police custody.

🚔 Officers Claim Innocence

Through their lawyer Danstan Omari, the officers want the High Court to stop their ongoing investigation, detention, and planned charges — insisting they were off duty when Ojwang’ was booked at the Central Police Station on June 7, 2025.

“There is need for a proper inquest at the lower court rather than intimidation and public shaming,” their petition states.

🕵️ What They’re Asking For

The two are demanding:

  • An inquest into Ojwang’s death.
  • A stop order halting further detention or prosecution.
  • Adherence to the Criminal Procedure Code (Sections 385-388) which directs an inquest for deaths in custody.

📑 Claims of Protocol Breach

Taalam argues that his arrest broke police protocol as he was booked at Lang’ata Police Station by a civilian, not a serving officer.

They claim the current investigation is unlawful, premature, and a diversion from finding the real culprits.

They want the court to issue a conservatory order stopping all legal actions until the inquest is concluded — saying only a transparent process will clear their names and serve justice for blogger Ojwang’.
